Belgian TED notice in lots: how many lots can I bid for?

Learn to read in a TED notice how many lots one company may bid for, how many it can win, and where the rule that decides between lots is written.

What the notice must say about lots

A contract can be divided into lots. In a TED notice, each lot has a number (LOT-0001, LOT-0002…), a title and often its own selection criteria. Before you prepare a tender, read two rules in the notice: how many lots one company may submit tenders for, and how many lots can be awarded to it.

Article 58, § 1, of the Belgian law of 17 June 2016 on public procurement says that the contracting authority states in the contract notice whether tenders may be submitted for one lot, for several lots or for all lots. Article 58, § 2, allows it, even where tenders may be submitted for several or all lots, to limit the number of lots that may be awarded to one tenderer, provided that this maximum number is stated in the contract notice.

The same paragraph adds that the contracting authority states in the procurement documents the objective and non-discriminatory criteria or rules it will apply to decide which lots are awarded when applying the award criteria would exceed that maximum. So the notice does not give the whole rule: the rest is in the procurement documents. Article 46(2) of Directive 2014/24/EU contains the same rules.

Where to read it in the TED notice

In the two notices below, these rules are in section 2.1.5, “Terms of procurement”. In the English view on TED, the lines read “Maximum number of lots for which one tenderer can submit tenders” and “Maximum number of lots for which contracts can be awarded to one tenderer”. A notice can also say “The tenderer must submit tenders for all lots”.

If one of these lines is missing, this page does not guess the number. Check it in the procurement documents or with the buyer.

Six lots, three tenders at most

TED notice 624432-2026 was published on 10 September 2026, in French. The title stays the notice’s own: “Belgique – Services de nettoyage de vitres – Lavage des vitres et châssis de divers bâtiments communaux, des abris/boxes vélos communaux et du CPAS - Année 2027 (reconductible)”. It is not translated here. The published buyer is the Commune de Waterloo. The published procedure is open.

The notice has six lots: “Bâtiments - abris/boxes vélos communaux”, “Bâtiments Régie Communale Ordinaire (RCO)”, “Ecole communale de Mont-Saint-Jean”, “Ecole communale du Chenois”, “Bâtiment Police WOP G” and “Bâtiments CPAS”.

The notice publishes a maximum of 3 lots for which one tenderer can submit tenders, and a maximum of 3 lots that can be awarded to one tenderer. One company can therefore bid for at most three of the six lots.

For each lot, the published turnover selection criterion reads (in French): « Le chiffre d’affaires annuel en nettoyage (domaine d’activités) sur les trois derniers exercices comptables mentionnés doit au minimum être de 500 000 € par lot et de minimum 1.000 000 € pour plusieurs lots. » That is at least €500,000 of annual cleaning turnover per lot and at least €1,000,000 for several lots. Bidding for several lots asks more here than bidding for one.

A tender for all lots, one lot awarded

TED notice 670009-2026 was published on 29 September 2026, in French. The title stays the notice’s own: “Belgique – Services divers d'entretien et de réparation – Marché de services en 2 lots ayant pour objet la maintenance préventive et curative des turbocompresseurs Sulzer HST et des turbocompresseurs HV-Turbo”. It is not translated here. The published buyer is Igretec, in Charleroi. The published procedure is open.

The notice states that the tenderer must submit tenders for all lots, and a maximum of 1 lot that can be awarded to one tenderer. According to the published text, the tender covers both lots, and only one lot can be awarded to the same company.

The published selection criteria differ by lot: lot 1 concerns Sulzer HST machines, lot 2 HV Turbo machines. Read them lot by lot.

The notice does not say how the awarded lot will be chosen if the same company ranks first for both. Under Article 58, § 2, of the law, that rule is in the procurement documents. Read it there, or ask the buyer at the published email address igretec@igretec.com.

What AOEX does not do

AOEX does not choose lots for the company and does not submit the tender. This page does not say which lot will be awarded or who will be selected.
